Insurance Producer Disqualification Criteria: A State Department of Insurance Directory

By identifying possible eligibility concerns early, organizations can make better-informed onboarding decisions and avoid preventable licensing delays.
Which Federal Disqualification Criteria Affect License Eligibility?
Under the McCarran-Ferguson Act, 15 U.S.C. § 1012, insurance producer licenses are issued and regulated by individual states. The federal government does not maintain a universal list of offenses that automatically disqualify an applicant from receiving a state insurance license.
However, federal law can prohibit someone from working in the insurance business, even if that person otherwise qualifies for a state license.
Felony Convictions Involving Dishonesty or Breach of Trust
Under 18 U.S.C. § 1033(e), an individual may not willfully engage or participate in an insurance business affecting interstate commerce if the individual has been convicted of:
- A criminal felony involving dishonesty
- A criminal felony involving a breach of trust
- Any federal offense under 18 U.S.C. § 1033
Depending on the elements and circumstances, regulators may treat fraud, theft, forgery, embezzlement, false statements, perjury, bribery, or the misuse of property held in a position of trust as disqualifying offenses.
An arrest, criminal charge, or indictment alone does not trigger the federal prohibition because Section 1033 requires a conviction. Likewise, not every felony creates federal disqualification. A felony that does not involve dishonesty or breach of trust generally falls outside Section 1033, although it may still affect eligibility under state law.
Convictions for Federal Insurance Offenses
A conviction for an offense under 18 U.S.C. § 1033 can also trigger the participation restriction under Section 1033(e). These federal insurance offenses include:
- Knowingly making materially false statements in financial documents presented to an insurance regulator.
- Willfully and materially overvaluing property or securities to influence a regulator.
- Embezzling, stealing, or misappropriating premiums, money, credits, or other property connected to an insurance business.
- Knowingly making false entries about an insurer’s financial condition or solvency with intent to deceive.
- Using threats or force to corruptly influence or obstruct an insurance regulatory proceeding.
The “any offense under this section” category is not expressly limited to felonies.
Obtaining a Section 1033 Written Consent Waiver
A prohibited individual may participate in the insurance business after obtaining written consent from an insurance regulatory official. The consent must specifically refer to Section 1033(e). This approval is commonly called a 1033 written consent waiver.
The individual must complete the regulator’s Section 1033 written consent process and satisfy all applicable state licensing requirements. Written consent removes the federal participation restriction, but it does not guarantee that the state will issue a license.
Penalties for Violating the Federal Restriction
A prohibited individual who willfully participates in the business of insurance without written consent may face a fine and up to five years in prison. An insurance professional who willfully permits that participation may face the same criminal penalty.
In addition, 18 U.S.C. § 1034 authorizes:
- Civil penalties of up to $50,000 per violation or the compensation received or offered for the prohibited conduct, whichever is greater.
- Federal court orders stopping prohibited conduct.
- Other available criminal, civil, or administrative remedies.
Federal compliance does not replace state review. States may deny, restrict, suspend, or revoke licenses for a wider range of criminal, financial, or professional conduct. Applicants with criminal histories should therefore review both Section 1033 and the licensing laws of the relevant state.
What to Do When a Producer Has a Disqualifying History
If a producer has a criminal conviction, regulatory action, or other potentially disqualifying history, the insurance company should pause onboarding and determine if the candidate can legally work in the proposed role.
Not every disclosed incident requires automatic rejection. Except where federal law creates a clear prohibition, the state insurance department generally makes the final licensing decision.
1. Verify the Candidate’s History
First, request enough documentation to understand the incident and its outcome. Relevant records may include:
- The charging document and final court disposition
- Sentencing and probation records
- Evidence that all requirements were completed
- Regulatory or administrative orders
- An existing Section 1033 written consent
- A written explanation from the candidate
Verify the candidate’s license status and reported regulatory actions through the NIPR Producer Database. If information conflicts with the candidate’s disclosure, give the candidate an opportunity to explain or correct the record.
2. Determine If a Federal Prohibition Applies
A candidate convicted of a felony involving dishonesty or breach of trust generally cannot participate in the insurance business without written regulatory consent.
If Section 1033 applies, the company should not permit the individual to participate in the business of insurance in a manner prohibited by the statute while the required written consent is pending.
Moving the person into an unlicensed position may not resolve the problem because the federal restriction covers many activities performed by an insurer’s officers, agents, employees, and other representatives.
3. Direct the Candidate to the State DOI
The company can ask the candidate to obtain case-specific guidance regarding the applicable licensing and consent requirements from the appropriate state insurance department. If Section 1033 applies, the candidate may need to apply for written consent, commonly called a 1033 consent waiver.
The company may support that request by providing:
- A description of the proposed position
- The candidate’s expected responsibilities
- The supervision the company will provide
- Restrictions on access to premiums or customer funds
- Other controls designed to reduce compliance risk
Written consent does not guarantee that the candidate will receive an insurance license. The candidate must still satisfy the state’s licensing requirements and the company’s appointment standards.
4. Make an Individualized Hiring Decision
If no absolute legal prohibition applies, the company should consider the nature of the offense, how long ago it occurred, its relationship to the position, the candidate’s subsequent conduct, rehabilitation, and if the candidate disclosed it honestly.
For employment decisions, the EEOC advises employers to ensure criminal-history restrictions are job-related and consistent with business necessity. Companies should avoid treating an arrest as proof that the candidate committed an offense.
If the company obtains the information from a third-party background-screening provider, it must follow the Fair Credit Reporting Act. This includes providing required notices before and after taking adverse employment action. The FTC outlines these employer requirements.

Q.1 Can you get an insurance license with a felony?
Yes, a felony does not always prevent someone from obtaining an insurance license. State regulators may consider the nature of the offense, how long ago it occurred, its relevance to insurance work, evidence of rehabilitation, and whether the applicant disclosed it honestly. However, a felony involving dishonesty or breach of trust may require written consent under 18 U.S.C. § 1033.
Q.2 What felonies can disqualify someone from an insurance license?
There is no single list that applies in every state. However, fraud, theft, embezzlement, forgery, misappropriation, and other offenses involving dishonesty or breach of trust receive particular scrutiny. States may also consider insurance-law violations, financial misconduct, or conduct demonstrating that the applicant is untrustworthy.
Q.3 Can a misdemeanor affect insurance license eligibility?
Yes. State insurance departments may consider misdemeanors involving fraud, theft, dishonesty, insurance misconduct, or other conduct related to the responsibilities of a producer.
Q.4 What is Section 1033 written consent waiver?
Section 1033 written consent is regulatory permission for a person with a disqualifying conviction to participate in the insurance business. The consent must come from an insurance regulatory official with appropriate jurisdiction and specifically refer to Section 1033. The waiver removes the federal participation restriction but does not erase the conviction or guarantee that the state will issue a license.

Disclosure requirements vary by state and depend on how the application defines terms such as “convicted.” Applicants should read each background question and its instructions carefully rather than assume that a sealed, expunged, deferred, or dismissed case does not need to be reported.
